Overview

In Australia, certain Commonwealth, State and Territory authorities are authorised to compulsorily acquire land (including all interests in land) for public purposes (such as the construction of a new road or a hospital).

Where land has been compulsorily acquired, the acquiring authority is required to pay fair compensation to the former landowner for that acquisition.
